1. Agreement to Terms

By accessing or using SparkPeople 2.0 (the “Service”), operated by SparkPeople Inc. (“SparkPeople,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent that you are at least 18 years of age and that all registration information you submit is accurate and truthful.

3. Your Account

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must provide accurate, current, and complete information during registration.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. The Service

SparkPeople 2.0 provides tools for personal goal setting, habit tracking, fitness tracking, daily planning, community engagement, and AI-powered coaching. The Service includes:

  • Free features: SparkStreaks, dashboard, community, fitness tracking, SparkPoints, and gamification.
  • Premium features: Full daily planner, AI-powered SparkCoach, premium assessment, and additional features as described on the Service. Premium features require a paid subscription.

5. Health and Wellness Disclaimer

The Service is not a medical or healthcare provider.

  • SparkPeople provides tools and coaching for general wellness, motivation, and goal achievement. It is not a substitute for professional medical advice, diagnosis, or treatment.
  • SparkCoach AI coaching provides general wellness guidance and motivation. It should not be relied upon for medical, mental health, nutritional, or clinical advice.
  • Always consult with a qualified healthcare provider before making significant changes to your diet, exercise routine, or health practices, especially if you have existing health conditions.
  • If you are experiencing a medical or mental health emergency, contact emergency services (911) or the 988 Suicide & Crisis Lifeline immediately.
  • You use health and fitness tracking features at your own risk. We are not liable for any health outcomes resulting from your use of the Service.

6. Community Guidelines

SparkPeople is committed to maintaining a positive, supportive community. When using community features, you agree to:

  • Be supportive and encouraging. SparkPeople is a positive environment. Treat others the way you would want to be treated.
  • No harassment, bullying, or hate speech. We do not tolerate discrimination based on race, gender, sexual orientation, religion, disability, or any other characteristic.
  • No spam or commercial solicitation. Do not use the community for advertising, multi-level marketing, or unsolicited promotions.
  • No dangerous health advice. Do not promote extreme diets, dangerous supplements, or unproven health treatments.
  • Respect privacy. Do not share other members' personal information without their consent.
  • No illegal content. Do not post content that violates any applicable law or regulation.

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines, at our sole discretion.

7. Your Content

  • You retain ownership of content you create and post on the Service (posts, journal entries, reflections, etc.).
  • By posting content to community features (teams, activity feed, blog), you grant SparkPeople a non-exclusive, worldwide, royalty-free license to display, distribute, and use that content in connection with operating the Service.
  • You are solely responsible for content you post. You represent that you have the right to share any content you submit.
  • Private content (planner items, journal entries, coaching responses, direct messages) remains private and is not shared with other users unless you explicitly choose to share it.

8. Subscriptions and Payments

  • Premium features require a paid subscription. Pricing and features are described on the Service.
  • Subscriptions automatically renew unless canceled before the renewal date.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.
  • We reserve the right to change pricing with 30 days' notice. Price changes will take effect at your next renewal.
  • Refunds are handled on a case-by-case basis. Contact us at contact@sparkpeople.com for refund requests.

9. Intellectual Property

  • The Service, including its design, features, content, and branding, is owned by SparkPeople Inc. and is protected by copyright, trademark, and other intellectual property laws.
  • SparkPeople, SparkCoach, SparkStreaks, SparkPoints, SparkTeams, SparkFavorites, SparkAmerica, and related names and logos are trademarks of SparkPeople Inc.
  • You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

10. Limitation of Liability

To the maximum extent permitted by law, SparkPeople Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Indemnification

You agree to indemnify and hold harmless SparkPeople Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or your violation of these Terms.

12. Termination

  • You may delete your account at any time by contacting us at contact@sparkpeople.com.
  • We may suspend or terminate your account if you violate these Terms or our Community Guidelines.
  • Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of California.

14. Changes to Terms

We may modify these Terms from time to time. We will notify you of material changes by posting a notice on the Service. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
